Application of General Sales Conditions

This section explains the terms and conditions under which the products mentioned on the website www.ferrogioielli.com are provided.

It is advisable to carefully read these sales terms and conditions before placing an order on the site. By ordering any product from the site, it is understood that you are bound by these sales terms and conditions. You can print a copy of these terms and conditions by selecting the print option from the “File” menu of your browser.


Validity of Offers The items visible on the site are available until stocks are exhausted. In the event of charging or withdrawal related to an unavailable item, Ferro Orologi e Gioielli undertakes to offer a purchase voucher or refund the customer within 15 days. Ferro Orologi e Gioielli will inform the customer by email who has ordered an unavailable item.


Product Prices

On the site, the price of each product is always mentioned unless there are errors.

Prices include 22% VAT but do not include shipping costs (when applicable), which will be added to the total expense.

By using a credit/debit card for order payment, the customer confirms that the card being used is owned by them. Those with a credit/debit card may be subject to validity checks and authorizations by the card issuer. In the event that the credit card issuer refuses to authorize payment, the order cannot be accepted.

Ferro Orologi e Gioielli is not responsible for any additional commission charges from the bank or credit/debit card issuer.

The site contains many products, and despite organizational efforts, inaccuracies may occur in labeling merchandise. Once aware of such errors, Ferro Orologi e Gioielli undertakes to correct them as soon as possible. If the valid price of a product is different from the price listed on the site, Ferro Orologi e Gioielli may contact the customer for instructions before shipping the product or reject the order and notify the refusal.

Note: Prices in the online store may differ from those in physical stores Ferro Orologi e Gioielli. The two entities are to be considered commercially distinct.


Orders

An order can be placed to purchase a product advertised for sale on the site by following the on-screen prompts after clicking on the item of interest. It will be possible to check and correct any errors in the order until the order is submitted.

An order cannot be processed until the total expense is paid. Payment can be made with major credit/debit cards or through PayPal, completing the payment page with the relevant details. Payments can also be made by bank transfer or cash on delivery for a maximum amount of €4.999,99.

After placing the order, the user will receive an email confirming the receipt of the order, including an order number and summary of the order placed and (if applicable) paid. All orders must be accepted, and confirmation of approval will be provided through an email verifying that the order has been processed.

Ferro Orologi e Gioielli may choose not to fulfill an order, without any liability, (a) if the ordered product is out of stock or no longer in production; (b) if there are issues with the authorization of payment with the customer’s credit/debit card or PayPal account.

Ferro Orologi e Gioielli is not responsible for any delays or non-delivery.

Ferro Orologi e Gioielli may decide (for various reasons) not to accept the order, considering itself relieved of any responsibility, and is not obliged to communicate the reasons for the refusal.


Cancellation and Returns

The cancellation, return, and refund policy respects the legal rights of the customer.

Civil Code art. 1510, paragraph 2: “Unless otherwise agreed or customary, if the thing sold must be transported from one place to another, the seller is released from the obligation of delivery by delivering the thing to the carrier (1678 and following) or to the forwarder (1737 and following); the goods travel at the risk and peril of the recipient; transportation costs are borne by the buyer (1475).”

Ferro Orologi e Gioielli is not responsible if one or more products are missing from the order due to tampering by third parties.

An order (or part of it) can be canceled at any time before the products are delivered, and up to 14 days after delivery (Right of withdrawal). This can be done by returning the products, following the provisions below or by contacting Customer Service via email at assistance@ferrogioielli.com.

The right of withdrawal applies only if the product, even if opened, is “as new”: intact, complete (including packaging), in perfect condition, and complete with all accessories, also intact. In the case of products that do not meet these characteristics, Ferro Orologi e Gioielli reserves the right to refuse withdrawal or apply a deduction to the price. The right of withdrawal does not apply to custom-made or personalized goods.

If the customer decides to cancel an order after the products have been shipped, it will be their responsibility to return them at their own expense. Ordered products can be returned within 14 days from the delivery date. Until the return, it is the customer’s responsibility to keep them in optimal conditions: the returned products must be unused and in the same condition as received, along with the original packaging.

After canceling the order and returning the product, the amount paid for the purchase by the customer will be fully refunded, excluding shipping costs (when applicable). The refund will be notified by email within a reasonable period. Normally, Ferro Orologi e Gioielli processes refunds by bank transfer, usually within 30 days of order cancellation, following the same methods used by the customer for payment at the time of the order.

In case the items arrive defective or damaged, the customer has the option to receive a full refund for the damaged products or their reshipment (upon return).

The request for replacement must be made within 48 hours of receiving the order, by sending an email to: assistance@ferrogioielli.com with the subject: Defective (or non-compliant) Products for Order No. XXX and with the text:

Name and Surname of the customer Registration email Order Number Date of receipt of the goods List of defective (or non-compliant) products Any additional comments

Attach photos of the damaged product(s).

The Ferro Orologi e Gioielli staff will then communicate the return process for the product.


Warranty

All products sold on Ferro Orologi e Gioielli are covered by the legal conformity warranty provided by articles 128-135 of the Consumer Code.

The legal warranty lasts two years from the delivery of the goods and must be asserted by the consumer within two months of discovering the defect.

The consumer can assert their rights under the legal warranty by contacting Ferro Orologi e Gioielli directly.
